NOTE: Skip this step if you plan to publish notice of your name change hearing. This step is only for people who requested not to publish notice of the hearing.
If you requested nonpublication, the judge will either agree or disagree with your request. The judge might wait for your background check results before deciding on your request. When the judge makes a decision, you should get a form called “Order Regarding Ex Parte Request for Nonpublication and Confidential Record.”
If the judge agrees, the order will say the request was “granted.” If this happens, skip the rest of this step and continue to Step 5.
If the judge disagrees, the order will say the request was “denied.” After a denial, you have 14 days to take the next step in your case. If you do nothing for 14 days, the judge could order publication or dismiss your case. You have three options for your next step:
Option A: You can accept the judge’s decision and continue with the name change. You will have to publish notice in Step 6 below. To choose this option, file form “Publication of Notice of Hearing Regarding Petition for Name Change” (PC 50) with the court.
Option B: You can stop the name-change process. To do this, use form PC 162 “Request for Hearing or Dismissal Regarding Name Change Proceeding.” Check box b to request dismissal. You can file again in the future if you want.
Option C: You can request a hearing about publication. Use the “Request for Hearing or Dismissal Regarding Name Change Proceeding” form that you got from the Do-It-Yourself Name Change tool to do this. Check box a on the form to request a hearing. Contact the court to schedule the hearing or find out if the court scheduled it.
At the publication hearing, you can explain why publishing notice of the name change would be harmful. Bring these things to your hearing, if possible:
- Two copies of the “Order After Hearing Regarding Denial of Ex Parte Request for Nonpublication and Confidential Record.” This is one of the forms from the Do-It-Yourself Name Change tool.
- Two copies of any documents you want to show the judge.
- If there’s another person with information that would help, consider asking them to come and speak at the hearing.

After the hearing, if the judge grants your request, continue to Step 5.
If the judge denies your request again at the hearing, you can:
- Ask the judge to dismiss the case and stop the name change process; or
- Ask the judge to order publication and go ahead with the name change. You will have to publish notice in Step 6 below.
